Purpose Of The Agreement

Client Wishes To Hire Company To Provide Services Relating To Client's - Event As Detailed In This Agreement. Vici Design Has Agreed To Provide Such Services According To The Terms Of This Agreement.

This Contract is to ensure that the Designer will bake, design, deliver or have ready for your pick up of your cake according to Clients specifications and the following provisions.

Please note: Payment is due upon ordering unless other arrangements for payment are made and noted in this contract.



Design/Flavor Changes

Any changes (design, guest count, flavors, colors, etc.) must be made within 24 hours of placing your order. Unless the order is placed 2 days prior to the pick up date, then no changes will be accepted, the order will remain as taken. Changes, if accepted, could result in an increase in the total cost. Any additional cost for design, rentals, additional cake, delivery, etc. will be added to the final payment amount and is due immediately upon making those changes. Final payments MUST be received in order for us to continue moving forward with your order. Design consultations are essential in planning your cake design. If no visual images are given &/or conversations are had concerning cake design, we will not be held responsible. If you have a specific design in mind that must be communicated with our designer.



Release of Liability & Cake Pick Up

The Designer shall have no responsibility for the condition of the cake once picked up. High temperatures, direct sunlight, and outdoor environments can adversely affect your cake. It is your responsibility to arrange an appropriate spot for the cake. The Client will accept all responsibility for anything that may occur after the cake is pickup. The Designer/Vici Design and/or Vici Design LLC shall not be responsible for the damage incurred once the cake leaves The Designer/Vici Design premises. The Client takes sole responsibility for pick up, transportation of the cake and set up of the cake if you choose to pick the cake up.



Use of Photographs

The Designer/Vici Design and/or Vici Design LLC. reserves the right to photograph your cake for our own reference, display, social media, promotional advertising and photographic reproduction for any purpose.



Payment

Payment is due upon ordering and is non refundable.

At a minimum, Client agrees that the payment fairly compensates the Designer for committing to provide services to the Clients and turning down other potential projects/clients.

Payments must be made in credit card.

Copyright Ownership. in the event that any copyrighted work(s) are created as a result of the Services provided by the Company in accordance with this Agreement, the Company owns all copyrights in any and all work(s) it creates or produces pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered, Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by the Company and may be used in the reasonable course of The Designer/Vici Design and/or Vici Design LLC business.



Failure to Perform Services

In the event Provider cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:

Immediately give Notice to Client; and

Attempt to find another competent professional to take its place with the mutual agreement of Client(s);

If another competent professional is not available or Client(s) do not agree to transfer of obligations to said alternate professional, Company will issue a refund or credit based on a reasonably accurate percentage of services rendered; and

Excuse Client(s) of any further performance and/or payment obligations in this Agreement.



Gluten Free/Allergy Notice

Vici Design LLC/ Vici Design is pleased to offer a variety of gluten free and allergy free options on our menu. However, we are not a gluten-free/allergy free facility and cannot ensure that cross contamination will never occur. We have processes in place to minimize that happening but there are gluten/allergens in the air and on work surfaces.

Gluten free/allergy free items are prepared in the same facility and ovens as our regular, flour items. We cannot guarantee that our products are 100% free of gluten. There is always the possibility of trace amounts crossing over from other kitchen areas. Please keep this in mind when ordering from our facility.
